Have you just lost your job in Oviedo? Time is running against you. Dismissal is one of life’s most stressful moments. Doubts assail you: Have they paid me correctly? Is what they’ve done legal? Am I entitled to unemployment benefits?

I am Manuel Barba, employment attorney in Oviedo. I practice in Oviedo and throughout Asturias defending exclusively the interests of workers. My objective is simple: to ensure the company doesn’t keep a single euro of what you’re owed for your seniority and effort.

Review Your Termination with Me Before Signing Anything Message me on WhatsApp

In employment law, deadlines are deadly. You only have 20 business days from the dismissal to file a claim. If you wait, you lose your right, even if you’re right.

Have you been dismissed in Oviedo? First thing: Don’t sign «In Agreement»

It’s the oldest trick in the employment market. The company puts a bunch of papers in front of you (dismissal letter, settlement, liquidation) and pressures you to sign quickly.

My advice as an expert dismissal attorney:

  1. Always sign as «NOT IN AGREEMENT»: Write it clearly next to your signature.
  2. Add the actual date: Sometimes they put earlier dates so your deadline expires. Put today’s date.
  3. Take a photo: Keep a copy of everything you sign.

Doing this doesn’t prevent you from collecting the settlement or applying for unemployment, but it leaves the door open for me to claim a higher compensation later.

How do we handle your dismissal?

1

I analyze your case and the legality of the termination

I review the letter, documentation and alleged causes.

2

I explain your options

Reinstatement (if void) or compensation (if wrongful).

3

I claim what you are entitled to

Before the company and, if necessary, I defend your case in court.

Types of Dismissal we handle at the law firm

Companies in Oviedo usually try to «slip in» cheap dismissals. My job is to reclassify that dismissal to increase your compensation.

Objective Dismissal.

The company claims they «have losses» or «organizational causes».

  • The reality: Often those causes don’t exist or aren’t documented properly. If we prove it, it becomes wrongful dismissal.

Disciplinary Dismissal

They accuse you of arriving late, poor performance or disobedience. It’s their favorite way to dismiss «for free».

  • The defense: The burden of proof is on the company. If they can’t prove that «very serious offense» before the judge, they’ll have to pay you maximum compensation.

Null dismissal

If the dismissal violates your fundamental rights (pregnancy, reduced working hours, retaliation for requesting vacation, etc.).

  • The result: They must reinstate you in your position, pay you interim wages (months you’ve been out) and contribute to social security for you.

How the claim process works in Oviedo (SMAC and Courts)

I know the terrain. I’m not a «cloud» attorney, I walk the floors of Llamaquique courts. This is how we’ll handle your case:

  1. Conciliation Request before the UMAC of Oviedo: We file the petition at the Mediation, Arbitration and Conciliation Unit (usually on C/ Santa Susana). It’s the mandatory preliminary step.
  2. Conciliation Hearing: We sit down with the company. Here, my position is firm. If they offer a fair amount, we close the agreement and you collect quickly. If not, we don’t accept crumbs.
  3. Trial at the Labor Court: I file the lawsuit and we go to trial. There I’ll dismantle their arguments with evidence, witnesses and case law.

How much can you claim?

The difference between a well-fought dismissal and an accepted one can be thousands of euros.

  • Fair Dismissal (Objective): 20 days per year worked (max. 12 monthly payments).
  • Unfair Dismissal: 33 days per year worked (max. 24 monthly payments).
    • Note: If you have seniority prior to February 2012, that period is paid at 45 days per year (max. 42 monthly payments). This significantly increases the amount!

I handle making the exact calculations. Don’t trust the figure the company puts in the letter.
